SOUTH DAKOTA STATEHOUSE State Capitol of South Dakota ruled out gay marriage,but a Judge said, South Dakota's gay marriage ban is unconstitutional. Meanwhile District Court Judge Karen E. Schreier wrote that the plaintiffs in the case "have a fundamental right to marry."
"South Dakota law deprives them of that right solely because they are same-sex couples and without sufficient justification,"
Decision has stayed pending on a possible appeal to the Eighth Circuit Court of Appeals.
